If spill over happens it will be applied based on the Priority date not based on the country quota

Few things:

3. Even if there is any spillover to EB3, nobody knows how USCIS will give those spillover number, will they go to EB3-ROW first or they will go as per the PD of Individuals regardless of Country of Origin.

I probabably know the answer of this question but would still like to confirm, just to be sure:

- First I-797B Valid from Jan 2004 to Sep 2006 <- Note: wasn't for 3 years
- First Visa valid from Jul 2004 to Sep 2006
- 1st US Entry Date from Aug 2005 till present date
(been to india in Dec 2007 for 1 month for visa stamping)
- First i-94 valid from Aug 2005 to Sep 2006


-Extended I-797A from Sep 2006 to Jan 2009 <-Note: not extended for 3 yrs
-2nd Visa/I-94 valid from Dec 2007 to Jan 2009

My questions?

1. Can my H1B Visa be extended again? This will be my 2nd extension.

2. Till what Date can be extended?
a. Jan 2010 (6 yrs from 1st I-797)
b. Jul 2010 ( 6 yrs from 1st visa stamping)
c. Aug 2011 (6 yrs from 1st US entry)

Meaning 6 yrs from 1st US entry subtracting the time you are out of USA for vacaion.
Meaning Sep 2011, if you were out of USA only for a month.

yes I did for the I-485 after one or two month since I got my recipt number ...

Is your PD current?
I don't know what is PD stands for !...

Is the Service Center processing I 485 applications around the RD of your 485 application?
I don't know how to check that , because when I click on the checking by the RD of the file in the service center , it doesn't show any I-485 on the list !...

and what is the IV ?

Bachelor's Degree in Computer Eng
Masters Degree in Computer Science
Nationality: India

Experience: 6 months (don't have docs to prove it though now..)

I would like to file my GC under EB2.

As per my little internet knowledge, is it true that for base requirements under EB2 are - MS + 0 years exp (Please correct me if i am wrong here)

I know one has to also prove that the job requires a MS degree ?? How can a lawyer suffice that requirement ?? Does 1 have to specify all latest hi-fi technologies for that ??

Are the other requirements of applying under EB2 ??

So to apply under EB2 one should belong to O*Net� JobZone 5, since i am comp eng/software developer i belong to category of O*Net� JobZone 4.

So for applying EB2 under O*Net� JobZone 4, do i have to show some experience related to that field/job ?? (Really confused about this one)

So that means it starts prior to Dec'9th for my case..????

For July filers these 2 dates are way too far.. for June filers there'll be few days difference only...

The RD (Receipt Date) is the date USCIS received your application. And 180 days for AC21 triggers from this date.. Not the ND (Notice Date), when USCIS actually enached your checks and issued you a receipt... The CRIS website usually shows ND...

Seems your RD is June 9th... Confirm from your I-485 receipts too...

Yes, you can GC is a future job. So its definitely possible.

Does it mean I can file a 485 even without joining the employer and can eventually join him before the 485 is approved. Any risks in this process?
