But, If you read the memo correctly, the language is vague at best, with references to a final rule that I couldnt find. Even the interim memo(Cronin) isnt available from the USCIS website.
My goal was not to restart the discussion on this. I simply wanted suggestions on how to approach USCIS to get clarity on this situation. Some options would be
1. Call USCIS : but do the people answering the call know the rules, and is their "interpretation" valid ?
2. Get an Infopass appt: Again, an IO may not be the right person responding to this
3. Contact the USCIS director : possible? how?
4. Contact AILA
5. Contact the Ombudsman
If anyone has thoughts and suggestions about how to get this clarified, please advise. My goal is to get a document from USCIS authoritatively stating their stance on this situation.

After the stab at Sony that Canon made in the press release stating they were releasing ~ 20 cameras this year, you don't think they'd let Sony get that far ahead, do you? :p
In my opinion, one of the more intriguing product announcements from Nikon today was the Coolpix 8700. If it improves significantly from the Sony, that could be a killer product. Right now, Canon is lacking a bit in the true consumer DSLR market. But then again, PMA is right around the corner. i think u will be covered under the new NC>180 policy so u can also send a demand letter through your lawyer after March 10, 08 (i am inferring this from updated FAQs for NC>180: pls see that FAQ for more info).

$930 plus a biometrics fee of $80; the fee total is $1,010. Exceptions listed below. There is no fee for applicants who are filing Form I-485 based on having been admitted to the United States as a refugee. Applicants 80 years of age or older are not charged a biometric fee; the fee total is $930. Applicants under 14 years of age: - Filing with the I-485 application of at least one parent have a fee total of $600 - Not filing with the I-485 application of at least one parent have a fee total of $930
I would assume that EAD and AP have to be paid for separately.

Now, as the AOS is filed, will it make a difference later on - filing AOS under EB2 would have got him the Green Card ealier?
Similar case. My lawyer told me that we can't apply the second I140 under premium because the original labor is gone with the first I140. So, I could not wait for second I140 and went ahead and filed for 485 under EB3.

I have a opportunity to become a Manager in the same company....The job duties would ofcourse be different from Programmer/analyst position...
So can I take the promotion and use the EAD...Will I be using AC21
I would suggest you to check with a good lawyer, as both Job duties and Job title both are changing for you, this might be iffy for AC21.
By the way, if you have not done, whenever you get a chance please mail letter against AC21 cases getting wrongful denials(IV action item).

I am currently on H1B, and my current company is not willing to sponsor me for GC. I am in my 5th year. I have found another company who has agreed to hire me and start my gc process, however, I am in a fix. This new offer is in CA and I am currently in NJ (+ my family)
I don't want to take this option unless it is absolutely necessary. My spouse, has the I-140 approved and not yet filed I-485. PD is Jan 04, EB3.
What are my options?
How many months left for you in fifth year? You need atleast 6 months to join another company so that they can do all the necessary steps in those 6 mnths before they file PERM. Are you trying to transfer to consultancy or full time employer?

Generally an I-485 applicant can stay abroad till the Advanced Parole remains valid. In your case the best bet is to change the pending I-485 case to consular processing.

Different service center case number starts with different letters.
My case is same as yours. Earlier it used to be EAC, the latest one is WAC.
You should be able to use WACXXX... for online tracking.

Those people who are all stuck in Labor certification.
1. What are the options going forward if our labors are not certified?.
2. What are the chances that BEC people are not able to meet their deadline (sep 30) in clearing LC?
3. Is there a justice and truth in life? Or everything depends only on time and luck?.
4. What if some of us get laid off.........our path ends?.
5. Is there something GOOD waiting for all of us?.
Waiting .......waiting...........waiting................wa iting sucks!.
Dude! Several threads exist for BEC issues, why don't you post your question on one of those. It will be inconvenient for existing and new members who are looking for suggestions/ideas on issues to go over duplicate threads for same information. Please search the forum before you open a new thread.

2) I-140 approved and pending AOS
3) 2 yrs. EAD available, expiring Sep. 2011
4) H1B will be expiring within 3 months (1 year left from 6 years limit)
My questions,
1) Can I use EAD instead of extending H1B? I want to stay with the same employer as a
full time employee.
2) If yes, is it required to inform INS? How and when?
3) In that case, how me, my son (middle school student, H4 & pending AOS) and wife's (EAD & pending AOS) stay in US will be justified with no valid I-94 (assuming I am not extending H1B anymore) ?
