My wife is in India for the last year to get new H1-B (6 years completed)
She has a valid dependant visa till May 2008

Based on new rule, she applied to reclaim 3 years of H4 for H1-B.
H1-B is approved, she is going to Chennai, India for stamping.

If for some reason H1 is denied, can she come back as dependant?

Yes ..she can use H4 if H1 is denied. Make sure consulate don`t cancel the H4 visa and the time of H1 B visa interview.

CALIFORNIA IMMIGRATION LAW FIRM FILES CLASS ACTION LAW SUIT AGAINST USCIS ON BEHALF OF IMMIGRANTS

    Posted on: 6/20/2008

    FOR IMMEDIATE RELEASE

Los Angeles Reeves & Associates, A Professional Law Corporation filed a class action lawsuit today in the U.S. District Court, Central District CA, Case Number SACV08-688 JVX (SHx) on behalf of tens of thousands of immigrant families whose adult children have been wrongfully denied of visas. Attorneys for the families are seeking to compel the United States Citizenship and Immigration Service (USCIS) to act in accordance with the provision of Child Status Protection Act (CSPA) that enables children to reunite with their families more quickly.

Prior to CSPA children who reached the age of 21 were no longer eligible to obtain an immigrant visa with the rest of their family. These children became known as age-outs. However, Congress enacted Section 3 of CSPA, codified as INA 203(h)(3), to keep children together with their parents. Specifically, this provision allowed children to automatically convert the visa petition and retain the original filing date known as the priority date after the child had aged out. As such, an aged-out child, who is a derivative beneficiary of the visa petition of his parent, can reunite with their family faster by utilizing their parents earlier priority date. As of today, USCIS has not only failed to comply with INA 203(h)(3), but has also failed to promulgate regulations or issue policy memorandum regarding this provision of law.

This case affects tens of thousands of immigrant families, said Robert L. Reeves, founder and Managing Attorney of Reeves & Associates, APLC. A child abroad who aged-out is eligible under CSPA for an immigrant visa, and if the child is in the United States, he or she will be able to adjust to legal resident status, explained Mr. Reeves.

The class action lawsuit presents two different classes of aggrieved individuals. Nancy Miller, a partner with Reeves & Associates and co-counsel, describes the two classes as those who filed petitions with requests for retention of the parents original priority date whose petitions were denied and those who have received no response at all to their requests for retention of the original priority date. In both cases parents remain separated from their children.

Although USCIS has granted some visa petitions and permitted retention of the earlier priority dates pursuant to INA 203(h)(3) to some, there appears to be no uniform policy from USCIS as a whole. Jeremiah Johnson, a partner with Reeves & Associates and co-counsel, said the lack of any regulations or even policy memorandum has lead to arbitrary and inconsistent decision-making affecting thousands on a global level. Joyce Komanapalli, an associate with Reeves & Associates and co-counsel, added USCISs refusal to issue visa petitions with the original priority date is at odds with the language, structure, history and purpose of the Child Status Protection Act.

It is incomprehensible why USCIS would deny these requests given the plain language of the statute and the Congressional history of CSPA. said Mr. Reeves.

The class action lawsuit is seeking to compel USCIS to properly adjudicate all cases filed under CSPA, or INA 203(h)(3), and comply with the requirements of retaining the parents original priority date in subsequent petitions filed by the parent.

I am feeling very envious of people having their applications processed at the TSC. TSC as seen by the examples above are renewing EAD in 2 weeks.

However, NSC is taking 2 months to process these EADs. There is a big difference between processing logic at NSC v/s TSC

I think the employee diversity at TSC is big compared to NSC. Therefore, people add their heart to work and processing is faster. In other words, Intent is pure. If you pay a higher fee for a service you get the return.

Contrast that with NSC. The employee diversity is poor. Employees are working just because it is a government job and their intentions are questionable, therefore a big lag in processing.

Hope the courts teach NSC a lesson, that nobody is above the law and they should be processing cases quickly as compared to their TSC counterparts. Hope somebody is listening.

I am starting this thread for people to share some nice sweet memories about the rally.

This Part 1 is basically for "WHO MET WHO"

Most of us in these forums - we talked on phones for a long time and discussed a lot of topics - and we met each other in real at the rally.

I was excited - and I want to share some of my experiences.

Please post some experiences on this thread like mine below

I drove from New York with 5 other dedicated IV members ie tnite, tikka, siraviny, ps57002 and a new member Arun

At the Rally I met Niloufer(needhelp) and Vandana, drona and other volunteers at the registration desk and was nice to meet you all.

Then came paskal and gsc999 who stuck a badge on my shirt "chanduv23" and then I met Shivakanth, Vijay Anand and other folks.

After that I met Macaca - lovable guy, some core members like indio0617, ashish, tamsen.

Then I met pappu. As soon as I greeted him he stood up. I thought he was respecting me. I felt honored. But after a while - he was standing up to anyone who greets him. Then I figured out that was his habit - and no respect or whatever :D:D:D

Then met Abhijeet who was carrying his guiter and then jazzbythebay, janilsal and other folks and Jay and Aman and all core team members

Then I met all the Chinese friends in the NY chapter, Jane, Sophia and it was nice knowing them

I did miss out a few names - but overall I loved this experience of meeting you all the folks

    chanduv23:

Same here. It was great meeting you all, seeing the faces behind the voices and names. It was an emotional high.

Pappu and me stopped at Union Stn for lunch on the way back after the rally. We were both physically drained and famished. Our jaws dropped when we spotted a desi restaurant there. You all should have seen how we attacked the food !

My wife got her H1b petition approved but not the change of status, that is she did not get the I94 along with the approval (she was outside the country at the time of approval). I know that she should be going out of the country and get the visa before she can start working. But After some research I found that there is another option, which is filing "amendment petition".

Has anyone done this before. If anyone has done this please share your experiences.

Does she has any H1 visa stamped in her passport?

It's better to apply for 485 after getting the H4 stamp. Once you leave the country it is considered abandoning the green card application. So you may have trouble getting a visa stamp. I may be wrong. So once you get your H4 stamp then you can come in with a valid H4. If you are planning to travel only in July why not file 485 and Advance parole then you can travel with Advance Parole as a backup. It's just my opinion.

My husband's I-140 will be approved in few days and our PD is current right now. Once the I-140 is approved we are planning to file for I-485 the sooner possible. The main reason is for me to apply or EAD so that I could work. You should also consider that I am travelling on July/august and of course I will require a visa appointment at the consulate to stamp my H-4.

    My questions are:

1- Is it safe to apply (once the I-140 is approved) before leaving U.S. For I-485 and EAD together?

2- What documents are required to file for EAD besides what is already being sent with the I-485?

3- What are the potential problems in leaving the country in July with an I-485 (with or without EAD, please tell me in both cases) submitted, and having a visa appointment at the consulate abroad in August to renew my h4 that expires in NOv 2007? Should I wait and apply for I-485 or EAD until Sept 2007?

In short: Could anyone please advise regarding the risks of filing in June the I-485, travel in July, have a consulate appointment abroad in August to stamp the H-4 visa that expires in Nov 2007 ? Should I wait until I come back? Much appreciated any replies.

"Charak says (In Sanskrit): Rinam Kritwa Ghritam Piwet ..."

I remember, some one mentioned to me about this same stuff. Centuries old charwak philosophy "Just do it kind of mentality" which led to hippy culture in 1960. Its seems to be making a come back :)

Its borrow or steal but live happily :)

Good points by the way. All this shows that we have to prepare for long years as this economic and social conditions are expected to last atleast until 2011 as per economic experts.

I like the food from a particular restaurant.
    - I go there often, enjoy the food, and recommend it to my friends.

I don't like the food from a particular restaurant.
    - I don't go there at all, even when I am hungry and I will tell my bad food experience to my friends - either convince them not to go there or let them decide on their choice.

    Reasonable? Logical? Practical?

I like what IV has done, what IV is doing currently.
    - I will visit the site often, get the information I want/need and recommend it to my friends

I don't like what IV has done, or what it is doing currently.
    - I will not visit the site, as it is a waste of time and I will tell my bad experience to my friends - either convince them to leave IV or let them decide on their choice.

    Reasonable? Logical? Practical?

Now, I don't like a particular restaurant, they serve bad food, bad customer service, waste of money, time - BUT I still go to the restaurant, eat the bad food, complain of the customer service, spend money knowing very well I am not getting its worth, and then stand up in the middle of this same restaurant floor and tell people this restaurant is not good (while eating) and tell my friends not to go to this restaurant (while I continue to go).

Reasonable? Logical? Practical? Or Unreasonable? Illogical? Impractical? - I would say second choice.

What do you as a reasonable, logical and practical person think?

    believers or non believers.

If for a social and noble cause, I can *donate*. If asked for what IV did, I cannot *participate*. if explained what we can change and with transparency and patience while eating a humble pie, i can *participate* *contribute* *put IV on a map* *market* Well thats just my view.

Nice analogy but note that IV for me is like samplers. If I like what is being offered, I would donate. If I want some thing to be given as sampler, I will buy, contribute and market it. I cannot donate for samplers which were given before I knew abt it, even though some good people got benefited.

This is depressing at best but lets take what lifes throws at us(in this case USCIS) and turn into positive.
We should have some action items and follow through. Below I have comeup with some as starting point..
    1. Prepare campaign materials, message (short and long), stories etc regarding this backlog.
    2. Pass it along to media. Schedule meetings with Senators, congressmen through state chapters and educate them.
    3. Volunteer in our communites as groups and spread the message and hopefully get some media attention.
    4. Contribute to IV for lobbying.
    5. Stay positive and don't stress too much regarding the GC.

Ideas don't cost us much but what we need now is actions.
